What does “Wrongful Death” mean?

Wrongful death accidents involve a loss of life due to actions and/or inactions of another party which may be in the form of an intentional or negligent or even a criminal act.

These cases are civil actions, separate from any potential criminal charges related to the death of a person, where surviving family members of the deceased person can seek compensation for their losses. A defendant could be found not guilty in a criminal case yet still be liable in a civil wrongful death action. The lawsuit can seek compensation for various losses, including economic damages such as loss of income/support, medical expenses, and funeral and burial costs, as well as non-economic damages such as loss of love, companionship, support, and guidance. In California, the lawsuit can be filed by the surviving spouse, domestic partner, children, or other individuals who would inherit from the deceased’s estate.
